1. Theme License

When you purchase a theme from our store it is licensed for only ONE store at a time. You are welcome to transfer the theme to another one of your Shopify stores if you discontinue its use on all of your other Shopify stores. It is against our terms of service for you to transfer or sell our theme to anyone else in part or whole.

You are welcome to make modifications to our themes. Shopify reserves the right to modify the footer referring to Shopify at the bottom of the theme at their discretion. We, Mile High Themes & Designs, reserve the intellectual property rights to our themes and customizations made to your theme.

If we discover that you have shared, bartered, traded, or otherwise transferred our intellectual property to another individual, group, or corporation in its original or a modified form then you will be subject to voiding and all parties must cease & desist use of our code.

2. Theme Updates & Support

Our themes have been designed to work across a large variety of devices and designs. If you find an issue with one of our themes please do not hesitate to contact our support. We will address these issues on an individual basis or through updates put out by both us and Shopify. These updates are free to anyone who has purchased a theme in the past. We reserve the right to discontinue support for any theme at any time.

3. Technical Support

We encourage you to start searching for support in our extensive support database. You are also always welcome to contact our support center with any concerns you may have. We ask that when you contact us that you please focus all inquiries on our themes so we may assist you as much as possible. You may also contact support if you would like a customization done or have any inquiries.

When creating a staff account for Mile High Themes support staff, we are not liable for any changes, customizations, or alterations to your shop that may result in lost profits or any special, incidental or consequential damages arising out of or in connection with our products or services. We have a page dedicated to the scope of our support services which we encourage you to visit.

4. Discount, Payment, & Refund Policy

All purchases are final and are not refundable unless otherwise stated.

All discounts must be applied at the time of purchase, and we will not make adjustments after any purchase has been completed. Discount codes are non-transferable, may be quantity controlled and subject to eligibility requirements. Limit one discount per order. We reserve the right to adjust orders or limit future support on theme purchases that have been found to be processed with ineligible discount codes.

We are not responsible for any delay in the processing of your payment method.

In the case a refund is granted we require that you delete all copies of the voided theme whether published or not. Limit one refund per customer. In the event the customer issues a chargeback the theme is immediately voided, and must be delted as mentioned above. If Mile High Themes wins a chargeback investigation we reserve the right to charge you any fees associated with the event.

Mile High Themes reserves the right to revoke the license of any store holder at any time without notice upon providing a refund for the full purchase price. We require the theme to be deleted and destroyed by the customer in these special cases.

American and Colorado citizens may be charged or liable for sales taxes.

All purchase prices appear in American dollars and we are not responsible for conversion fees or any other fee associated with overseas purchases.

5. Warranty & Liability Limitations

All themes, support, customizations, and any other commodities sold are sold "as-is," and may not perform as you wish or be compatible with third-party plugins or applications available from the Shopify store or via other methods.

Neither Mile High THemes, nor any of our affiliates, independent contractors, or employees will be liable or have responsibility, of any kind, for any loss or damage, of any kind, that you incur because of an interruption or failure of your website or use or misuse of our products. We will not be liable or have responsibility for any third-party attacks, viruses, or malicious software that may affect your website or your computer.

We cannot guarantee that your theme will update error-free or as you wish.

Mile High Themes and its employees may suggest someone to do development on your theme we cannot guarantee that these people will do work to your liking. We take zero responsibility or liability for the works of these individuals or groups. Our suggestions are not endorsements, but an effort to provide you with the best support possible. If you encounter an issue with these people please let us know, and we will review the individual at our own discretion.

6. Content Disclaimer

Mile High Themes provides complimentary advice & support related to many subjects that we are not liable for. While we make a reasonable effort to ensure completeness and accuracy in all cases this content is provided "as-is," and expressly disclaims any warranties or liabilities. The use of this advice is considered at your own risk, and we are not responsible for any results or lack thereof. This includes but is not limited to loss of business or inability to conduct business, that may result as a result of use or non use of portions or all of content provided. We are not experts in legal, tax, accounting, or business practices and content provided should not be construed as professional advice. Always consult a qualified expert for advice in such matters.

7. Browser & Device Compatibility

We strive to have our website and themes to be compatible across a majority of modern devices including, but not limited to, iOS, Android, Windows, Microsoft Edge, Mozilla Firefox, and Google Chrome. Some features may be unavailable in these browsers. We are also unable to guarantee that our themes will pass W3C, Google PageSpeed Insights or other validation services. Please report any device, system OS, or browser specific problems to our support team.

8. Governing Law

All disputes arising from the use or non-use of Mile High Themes products and interpretation of any or all agreements herein will be governed by the laws of the United States of America & the state of Colorado. In all cases, Mile High Themes' liability will be limited to the total purchase price and without regard to consequential or punitive damages.

9. Changes to This Agreement

We reserve the right to make changes to our terms and conditions or our prices without notice. Where allowed by law, changes made to our terms and conditions become retroactively applied to all customers, no matter when the purchase was processed. View our most current terms & conditions here.
